1. Scope of Validity and Nature of Products
1.1. By entering into a contract, these Terms and Conditions, in the current wording valid at the time of the conclusion of the contract, apply to all mutual claims between the customer and Lesilea GmbH (hereinafter referred to as "GreenGuru").
1.2. IMPORTANT NOTICE: All products offered on the website www.greenguru.cz (including but not limited to kratom tablets, kratom powder, fruit-infused variants, and 7-OH extracts/strips) are sold exclusively as botanical specimens for collecting, decorative, study, or scientific purposes. These products are not classified as food, dietary supplements, medicinal products, nor are they intended for human consumption, ingestion, or vaporization. GreenGuru assumes no liability for any damages resulting from improper use or handling of the products in violation of this defined purpose.
2. Contractual Partner / Eligible Customers
2.1. GreenGuru enters into contracts exclusively with fully legally competent natural persons over the age of 18.
2.2. Registration is not required to place an order. Customers may order without creating an account. If an account is created, all provided information must be true and complete. Registration may only be carried out under the customer's own name.
2.3. If GreenGuru inadvertently accepts an order from a person who does not meet the above-mentioned criteria, GreenGuru is entitled to withdraw from the contract within a reasonable period following notification.
3. Conclusion of the Contract
3.1. By submitting an order (selecting a product, filling in the required details, and confirming the order), the customer submits a binding offer which GreenGuru must first accept.
3.2. GreenGuru is under no obligation to accept the customer's offer.
3.3. A purchase contract for the goods is concluded only upon delivery of the goods to the customer. The automated order receipt email does not constitute an acceptance of the offer.
3.4. The text of the contract is not permanently stored. Following the order, the customer will receive an email confirming the details of the order. The current wording of the Terms and Conditions is always available at www.greenguru.cz.
4. Right of Withdrawal (Return of Goods)
4.1. Consumers have the right to withdraw from the contract and return the goods within 14 days of receiving the goods without giving any reason.
4.2. Business Exception: This right of withdrawal does not apply to entrepreneurs, businesses, or legal entities purchasing goods within the scope of their commercial or professional activities, who provide their business identification details (e.g., Company ID, VAT number, or registered business name) during the ordering process.
4.3. For an easy and rapid withdrawal process in accordance with current EU regulations, customers may use the self-service My Order section located in the footer of the e-shop website, or by clicking the direct link provided in the order detail email. The direct link for managing returns is: /my-order/.
4.4. The customer is obliged to return the goods without undue delay to the company's registered address. The costs associated with returning the goods shall be borne entirely by the customer.
4.5. The refund will be processed no later than 14 days from the moment the customer provides verifiable proof of dispatching the goods back to the seller, or from the date of physical delivery of the returned goods to the seller.
5. Exceptions to the Right of Withdrawal
Withdrawal from the contract is not possible for:
- goods manufactured to custom specifications or personalised,
- goods in sealed packaging which were unsealed after delivery and are not suitable for return due to health protection, hygiene reasons, or to preserve the purity and stability of the botanical specimens,
- digital content, if the customer gave prior explicit consent to immediate performance before the expiry of the withdrawal period.
6. Inspection of Goods – Compensation for Damage / Depreciation
The customer is entitled to inspect the goods (the hermetically sealed packaging of the collector's item) only in a manner customary in a physical retail store. If the goods are depreciated or the protective packaging is breached beyond the scope of such an inspection, compensation for the reduction in value may be claimed.
7. Unavailability of Goods
If it is impossible to deliver the goods after the contract has been concluded, GreenGuru may offer a replacement or withdraw from the contract. The customer will be refunded all payments received for the unavailable items.
8. Errors in Data / Pricing
In the event of obvious errors (e.g., typographical errors in pricing), GreenGuru reserves the right to cancel the contract unless the customer confirms the order at the correct price.
9. Delivery Time and Transfer of Risk
9.1. Delivery usually takes place within 2–7 business days, but no later than 30 days. The delivery period begins upon receipt of payment (for advance payment methods) or upon order confirmation (for other payment methods).
9.2. The risk of damage to or loss of the goods passes to the customer only at the moment the customer takes physical possession of the goods.

11. Prices
All prices listed on the e-shop are final and inclusive of all applicable taxes and fees. However, depending on the country of delivery, local taxes, customs duties, or import fees may apply, which shall be borne entirely by the buyer. The decisive price is the price stated in the shopping cart at the time the order is submitted.
12. Payments and Default
Available payment methods are specified during the checkout process and correspond to the information on the "Shipping and Payment" page. In the event of default on payment, statutory default interest and a reasonable fee for reminders may be charged.
13. Retention of Title
The goods remain the sole property of GreenGuru until they are paid for in full.
14. Warranty and Claims (Complaints Procedure)
14.1. The rights and obligations of the contracting parties regarding rights arising from defective performance are governed by the relevant generally binding legal regulations. GreenGuru warrants to the customer that the goods are free from defects upon delivery and conform to the declared description (collector's item / botanical specimen).
14.2. Given the delicate nature of the products (botanical specimens, extracts, and collector's items), rights arising from defective performance cannot be claimed for defects caused by improper storage, mechanical damage, natural degradation, or after the hermetically sealed protective packaging—which ensures the stability and laboratory purity of the specimen—has been opened.
14.3. Any additional commercial warranty provided by the manufacturer beyond the scope of statutory obligations is applicable solely and directly against the respective manufacturer and in accordance with their specific warranty terms.
15. Liability
GreenGuru is liable only for intent and gross negligence, with the exception of personal injury and liability under the Product Liability Act.
16. Protection of Personal Data
Personal data is processed in accordance with the GDPR for the purposes of order fulfillment. Complete details can be found in the Privacy Policy on the website.
17. Obligation to Notify Changes
The customer is obliged to immediately notify GreenGuru of any changes regarding their delivery address or contact details.
18. Language of the Contract
The contractual language for customers with delivery to Austria is German.
19. Place of Performance
The place of performance is the registered office of Lesilea GmbH in Vienna.
20. Assignment of Claims
The customer must notify GreenGuru in writing of any assignment of their claims to a third party.
21. Governing Law
The applicable legal framework is Austrian law, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The statutory consumer protection laws of the country where the consumer has their habitual residence remain unaffected.
22. Jurisdiction
For lawsuits brought against GreenGuru, the court at the registered office of the company shall have jurisdiction. The consumer may only bring legal action in the court of their place of residence, provided that this is required by law.
23. Severability Clause
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.
24. Alternative Dispute Resolution (ADR)
We recognise the Internet Ombudsstelle as an out-of-court dispute resolution body.
